Terms & Conditions

The Imps by SuperNfty, Super Nfty Floating Heads, Superballs, (with the exception of Spirits*) furtherly referred to as the ‘SuperNfty Collections’ or ‘SuperNfty NFTs’, are collections of digital artworks connected to a Non Fungible Token (NFT) on the Ethereum Blockchain.

Please read the terms and conditions carefully. SuperNfty may amend these Terms at any time by posting a revised version on our website. The revised version will be effective at the time we post it. If we change the Terms in a way that reduces your rights or increases your responsibilities, we will provide you with a notification.

OWNERSHIP

1. The NFT;

You own the NFT. Ownership of the NFT is mediated entirely by the Smart Contract and the Ethereum Network: at no point may SuperNfty seize, freeze, or otherwise modify the ownership of any SuperNfty NFT.

OWNERSHIP You agree and understand, that you are solely responsible for determining the nature, potential value, suitability and appropriateness of risks for yourself. SuperNfty Collections and their connected services are provided “as is” and “as available” without warranty of any kind. By using the SuperNfty's services you are accepting sole responsibility for any and all of your transactions involving SuperNfty.

2. Personal use;

If you own a SuperNfty NFT, SuperNfty grants you a worldwide, royalty-free license to use, copy and display the purchased artwork, any unlockable content and any derivative content for personal and any non-commercial use of said collectible.

3. Commercial use;

Subject to your continued compliance with these Terms, SuperNfty grants you an unlimited, indefinite, worldwide, commercial license to use, copy, display and sell the purchased NFT artwork, any unlockable content and any derivative content of said SuperNfty NFT for commercial use.

For the sake of clarity, SuperNfty retains the ultimate copyright, but nothing in this section will be deemed to restrict you from (i) owning or operating a marketplace that permits the use and sale of derivative works of your Super Nfty Floating Head(s), provided that the marketplace cryptographically verifies each Super Nfty owner’s rights to use the NFT for their Super Nfty collectible to ensure that only the actual owner use the artwork; (ii) owning or operating a third party website or application that permits the inclusion, involvement or participation of derivative works of your Super Nfty NFT, provided that the third party website or application cryptographically verifies each Super Nfty owner’s rights to the artwork for their Super Nfty collectible to ensure that only the actual owner can display and sell said derivative works, and provided that the collectible and derivatives are no longer visible once the owner of the purchased SuperNfty NFT leaves the website/application; or (iii) earning revenue from any of the foregoing.

PROHIBITED USES

You may not use or encourage, promote, facilitate, instruct or induce others to use the SuperNfty NFT and services for any activities that violate any law, statute, ordinance or regulation; for any other illegal or fraudulent purpose or any purpose that is harmful to others; or to transmit, store, display, distribute or otherwise make available content that is illegal, fraudulent or harmful to others.

SuperNfty is committed to complying with copyright and related laws and requires all SuperNfty collectors to comply with these laws. Any similarities of SuperNfty NFTs to known people or fictional characters is purely coincidental. SuperNfty cannot be liable for any copyright infringement committed by SuperNfty NFT-holders. Accordingly, you may not use any Super Nfty content to disseminate any material or content, in any manner that constitutes an infringement of third party intellectual property rights. You agree that you will be solely responsible for your use of SuperNfty services.

*SPIRTIS, FALLEN HEADS & COLLAB PIECES

The Spirits (Spirits by SuperNfty), the Fallen Heads (Fallen Heads By SuperNfty) and collab pieces (in any SuperNfty collection) are different, we limit the ownership rights to the NFT (1) and personal use (2). We, SuperNfty LLC, retain full commercial use over the Spirits.
